Acceptable Use Policy

This Acceptable Use Policy (the “Policy”) explains what is and is not allowed when using the Hmong Memorial website, Memorial Studio, and related services (collectively, the “Services”). This Policy applies when it is referenced in or presented with the Hmong Memorial Terms and Conditions (the “Terms”). Once effective, it forms part of the Terms, and a violation of this Policy is a violation of the Terms. Capitalized terms not defined here have the meanings given in the Terms.

Hmong Memorial is designed for respectful, lawful personal and family memorial creation. You may use the Services only for purposes consistent with that design, the Terms, this Policy, and applicable law.

1. Respectful and Lawful Use

You may not use the Services to create, upload, request, distribute, or assist with content or conduct that:

  • is illegal or encourages, facilitates, or instructs others to commit unlawful acts;
  • exploits, endangers, threatens, abuses, stalks, harasses, or intimidates another person;
  • targets a person or group with dehumanizing abuse, threats, or encouragement of unlawful discrimination or violence based on race, ethnicity, nationality, religion, sex, sexual orientation, gender identity, disability, age, or another characteristic protected by applicable law;
  • is defamatory, fraudulent, deceptive, or intended to impersonate another person or misrepresent a memorial, death, identity, relationship, or family authorization;
  • violates another person’s privacy, publicity, copyright, trademark, contractual, or other rights; or
  • is intended to facilitate fraud, threats, targeted harassment, exploitation, unlawful discrimination, or another unlawful injury to a person, family, community, or organization.

Good-faith criticism, complaints, reports of suspected abuse, requests for help, and neutral or educational discussion of a person’s passing, family history, discrimination, Hmong culture, faith, clan traditions, or memorial practices are not prohibited solely because they address difficult subjects. Context and apparent purpose matter. This does not permit threats, targeted harassment, exploitation, hateful conduct, or graphic content.

2. Prohibited Harmful Content

You may not submit, request, create, or use the Services in connection with content that:

  • is sexually explicit, exploitative, abusive, or nonconsensual;
  • sexualizes or exploits a minor, constitutes child sexual abuse material, or attempts to create, transform, conceal, or obtain such material;
  • depicts, threatens, celebrates, encourages, or instructs serious violence, abuse, torture, self-harm, or graphic injury or death;
  • uses weapons or other means to threaten, facilitate, encourage, or instruct harm; or
  • is otherwise graphic, explicit, abusive, unlawful, or incompatible with respectful memorial use.

A neutral, non-graphic memorial reference to the cause or circumstances of death, recovery, or support is not prohibited solely because it addresses a difficult subject.

If prohibited content appears in generated artwork, do not use or distribute it. Stop using that output and report the concern without sending the image.

If we become aware of apparent child sexual exploitation or abuse, we will take the actions and make the reports required by law. Do not send suspected prohibited imagery to our reporting address; provide only non-image information reasonably necessary to identify the concern.

3. Family Photograph Requirements

Family photographs uploaded to Memorial Studio must be appropriate family portraits for respectful memorial use and must comply with this Policy. Do not upload content that is sexual, exploitative, violent, graphic, abusive, unlawful, or otherwise unsafe or inappropriate for the Services.

These requirements apply to every upload. We may use automated or other measures to help enforce them. Those measures may make mistakes and do not relieve you of responsibility for the content you submit. Acceptance of an upload does not establish that it complies with this Policy, and declining an upload does not imply wrongdoing by the person who submitted or appears in it.

These requirements apply without regard to a person’s identity or protected characteristics. Traditional, cultural, or religious clothing is not prohibited solely because of its association, but every photograph must comply with this Policy.

4. Rights, Consent, and Other People’s Information

You may submit a photograph, name, memorial detail, family message, or other material only if you have the rights, permissions, and family authority needed to use it for the requested memorial.

Do not:

  • create a false memorial or falsely claim that a person has died;
  • use another person’s identity, likeness, private information, or copyrighted work without lawful authority;
  • submit a photograph depicting a minor unless you are the minor’s parent or legal guardian or have authorization from the parent or legal guardian that you can substantiate upon request;
  • disclose Social Security numbers, financial-account information, government identification numbers, medical records, passwords, authentication codes, or other sensitive information that is not needed for the memorial; or
  • use memorial content to deceive, defame, shame, exploit, harass, or harm a depicted person, a surviving family member, or anyone else.

5. Service and Account Integrity

You may not:

  • access or attempt to access another person’s account, invitation, project, photograph, preview, or downloaded file without authorization;
  • share or misuse an invitation or account in a way that defeats access restrictions;
  • remove or bypass notices, watermarks, access restrictions, or other protective controls;
  • use bots, scrapers, or automated scripts to access or copy the Services or their content, except for ordinary browser functionality, assistive technology, or other use expressly authorized by us or required by applicable law;
  • probe for vulnerabilities, introduce malicious code, disrupt the Services, interfere with another person’s use, or place an unreasonable burden on the Services;
  • reverse engineer, copy, modify, or create derivative works of the Services except where applicable law does not allow that restriction; or
  • evade a suspension, restriction, or other enforcement action.

6. Prohibited Commercial and Model-Development Uses

Unless Hill Tribe Solutions gives written permission, you may not:

  • resell, sublicense, white-label, or commercially exploit the Services;
  • sell or license generated outputs as stock content, templates, datasets, or stand-alone artwork;
  • copy or use nonpublic portions of the Services or Hill Tribe Solutions’ proprietary materials to build or offer a competing service in violation of the Terms or applicable intellectual-property law;
  • use any output, prompt, template, cultural-reference material, or other portion of the Services to train, fine-tune, evaluate, benchmark, or develop an artificial-intelligence or machine-learning model; or
  • imply that Hill Tribe Solutions, Hmong Memorial, a cultural authority, a depicted person, or another person or organization endorses you or your use.

Authorized personal, family, memorial-service, printing, and related noncommercial uses remain permitted as described in the Terms.

7. Enforcement

We may take proportionate actions reasonably available to us when we believe that this Policy, the Terms, another applicable policy, or the law has been violated. These actions may include refusing or limiting content or requests, stopping processing, restricting or terminating access, preserving relevant records, making legally required reports, or taking other appropriate protective action. We handle personal information in connection with enforcement as described in the Privacy Policy and applicable law.

We may act without advance notice when reasonably necessary to protect a person, family, the Services, or others; prevent harm or abuse; preserve evidence; or comply with law. We may disclose information to law enforcement, courts, regulators, or other authorized parties when permitted or required by law.

Content and enforcement decisions can be imperfect. We do not guarantee review, appeal, or reversal of a decision. If we allow you to correct a violation, that opportunity does not prevent us from acting on repeated, serious, or unlawful conduct.

8. Reporting a Concern

To report suspected misuse of Hmong Memorial, email [email protected] with the subject “Acceptable Use Concern.” Include enough information for us to identify and evaluate the concern, but do not email prohibited imagery or unnecessary sensitive personal information.

If someone is in immediate danger, contact local emergency services. Hmong Memorial is not an emergency or crisis-response service.

9. Changes to this Policy

We may update this Policy as the Services, risks, or law change. Changes apply prospectively from their stated effective date. We will provide reasonable advance notice of material changes and obtain affirmative acceptance when required by law or the Terms. Changes required immediately for legal, security, or safety reasons may take effect sooner, with notice as reasonably practicable.
